About David O'Toole

David O’Toole joined Bragança Law after spending 24 years as a senior staff attorney at the Federal Trade Commission’s Midwest Region in Chicago. A three-time graduate of the University of Chicago, where he received a B.A. in History (1984), an M.B.A. (1988) and a J.D. (1992, with honors), David began his legal career spending almost six years in private practice in Chicago and Washington, D.C., working on antitrust, white collar defense, and general commercial litigation. for twenty-four years.

While at the FTC, David led teams that challenged companies for deceptive marketing involving dietary supplements and health products, operating as pyramid schemes, and engaging in deceptive consumer credit and mortgage relief offerings. David brought the first FTC case against a debt collector in which the company was shut down by a court, including freezing the assets of its top managers before ultimately being returned to consumers. David also brought the first two FTC cases shutting down telemarketers using robocalls to pitch deceptive extended auto warranties.

David also worked on antitrust matters, including price-fixing investigations and challenging mergers and other business combinations mostly in the health care field. Many of the individual defendants in David’s cases were subsequently prosecuted by the USDOJ, some receiving sentences of more than twenty years.

David has been an adjunct professor at Loyola University School of Law and the John Marshall Law School, teaching Consumer Protection Law, Antitrust Law, and International Antitrust Law and has been a guest lecturer at the University of Chicago Business School and Northwestern Law School. He gives training and presentations to domestic and foreign law enforcement, civic groups, trade associations, and consumer groups.

David's cases have been featured in national news publications such as the New Yorker, the New York Times, the Washington Post, and the Chicago Tribune.
